6. Do I need to apply for change of use?
Planning permission is NOT needed when:
- The existing and the proposed uses fall within the same “use class” provided that the development has not been subject to a condition from a previous permission for the same site restricting changes of use within the same class;
- If the Town and Country Planning (Use Classes) Order 1987 (as amended) says that a change of class is permitted to another specified class.
More information on use classes can be found on the Planning Portal - Use Classes.
If you would like to confirm the use class of a building or land you will need to apply to the council for a Certificate of Lawfulness (Existing Development) to verify that no change of use has occurred. See FAQ 1.
